Haryana clears 10 pct reservation for 'economically backward classes'

The Haryana government on Wednesday approved the proposal for providing 10 per cent reservation to "economically backward classes" in general category, as recommended by the Haryana Backward Classes Commission.

The Council of Ministers, which met under the Chairmanship of Chief Minister Bhupinder Singh Hooda today, accepted the recommendations of Cabinet Sub Committee.

The Council of Ministers had constituted the Sub Committee on December 12 last year to consider the recommendations of the Backward Classes Commission and to suggest specific programmes for economic uplift of the community.

The Sub Committee was headed by state Finance Minister H S Chatha on the issue of reservation in government jobs for economically backward persons in general category.

Later, addressing a meeting the chief minister said the reservation for economically backward classes would be "vertical and not horizontal".

The Cabinet Sub-Committee is also of the opinion that those, who claim benefit of reservation under other categories, will not be entitled to claim benefit of reservation under this category.

The Haryana Backward Classes Commission had submitted its report on January 22.

I think Brahmins are around 8-9%, Punjabies are 2-3%, same for Baniya and Rajput, so in total may make it a mxium of 15-18% population...with in this 15-18% this 10% reservation will be provided to those are economically backward yaani 15-18 % ka 50% bhi le lo to around 8-9% population of Haryana ke liye 10% reservation.....

waah re Jaato, itne din rail roki, gharon se bhaage-bhaage firey aur fir bhi mila to kitna 10% aur wo bhi including other 4 castes, which in total makes around 36-38% of total population of Haryana yaani itni population ke liye 10% reservation....

isiliye to Jats jaroor lohe ke chane chaba ke paida hue they......rail roki, shaadhan tudwaaye, bachche gawayen, maare-maare firey itne saal aur ye C.M. jaise reservation de gaye generals ko.....aur nahin to 5% hi de diya hota...population ki ration dekh ke......

ya fir jis caste ki jitni population hai usi hisaab de ke jats ko 27% ke hisaab se 27% alag rakho aur baakiyon ko jo milta hai utna do aur karo free har cheej ko.....waah re Jat leader ye tera achcha nyaay hai apni hi community ke saath.......

aur fir jab Jat ko reservation dene ke itne thode se antral mein hi ye drama rachna tha to Jats ko OBC ki Special category banaane ke bajaaye, General ki hi special category bana diya hota.....yaani General A aur General B.......official social degradation bhi aur fir reservation bhi mili to just 10% wo bhi three times population ke liye, jabki unko 1 to 1 ka reservation de diya.....

The announcement of the populist decision by Chief
Minister Bhupinder Singh Hooda to accept the recommendations of a sub-committee
batting for10 per cent quota for the economically backward classes may be good
politics but it is legally untenable.

With the 10 per cent quota for the poor pushing up the total reservation to
67 per cent in the state, the decision may run counter to the 1992 judgement of
the Supreme Court in the Indira Sawhney and others versus Union of India and
others which held that “reservations contemplated in Clause (4) of Article 16
should not exceed 50 per cent.”

Currently, Haryana provides 20 per cent quota in jobs to the Scheduled Castes
(SCs) and 27 per cent to the backward classes (BCs). On December 12 last year,
on the recommendations of Justice KC Gupta-headed Haryana State Backward Classes
Commission (HSBCC), the Hooda government announced to provide 10 per cent
exclusive quota for the five castes, including Jats. With today's announcement,
the quota in the state would go up to 67 per cent- a decision apparently taken
with an eye on the forthcoming Lok Sabha and Assembly elections.

The decision to cross the apex court's 50 per cent 'lakshman rehka' by the
Hooda government is seen as following in the footsteps of Tamil Nadu which
provides a quota of 69 per cent in government jobs and educational institutions.

However, it is here that similarities between Tamil Nadu and Haryana end. As
a safeguard to prevent judicial review, Tamil Nadu had enacted the Tamil Nadu
Backward Classes, Scheduled Castes and Scheduled Tribes (Reservation of Seats in
Educational Institutions and Appointments in Services under State) in 1994 after
getting the assent of the President. On July 22, 1994, the Tamil Nadu government
requested the union government to include this Act in the 9th Schedule to the
Constitution so that it could not be challenged as violation of any fundamental
right contained in Part 3 of the Constitution, including Articles 15 and 16 and
gets protection under Article 31-B. Later, the Bill was brought within the
purview of the 9th Schedule to the Constitution to give it protection with
regard to judicial review.

However, the Haryana Government would be on a weak wicket if the decision is
challenged in court. Some organisations have expressed their intention to
challenge it.
Official sources said even in the Indira Sawhney case, the SC had said while
50 per cent shall be the rule, it was necessary not to put out of consideration
certain extraordinary situations inherent in the great diversity of the country
and people. But in Haryana, there hardly seem to be any extraordinary situations
with the government claiming "Haryana No 1" status in development.

I feel it is a welcome start by any government to move beyond the politics of caste reservation and should be looked upon as a step for real poor upliftment beyond cast and creed.

Atish, I can only wish it does not fall flat.

Caste based reservation has many evils, rich exploit it, politics depends on it, poor high-cast people suffer. Am either for no reservation or economic-condition based reservation.

Kyaa koi bhai from JL ek RTI laga sakta hai, jismen Haryana ki Religion wise and Casewise population ke 2011 mein hui janganna ke aankde maange jaayen aur dekha jaaye ki present mein konsi caste ki kitni population hai......

kyonki 69.5% reservation ho jaane ke baad remaining 30.5% mein se Jats (Hindu+Sikhs+Muslims) 35% population banta hai aur 35% ko abhi reservation diya 10% to bacha 25% yaani 30.5% mein se 25% to Jats ka hi bacha hua hai jo ki saari castes ko Horizontal system ke tahat bander-baant mein mil raha hai....seems Jats again need a big revolution....?...waah re Jaaton ke so called naye Mashiha...wo kaise kahte hain ki "Andha roti (exact word..???) bhi dega to fatkar ke? ya fir ye आंधी बाँटे कुत्ते चाटें, अंधा न्योंदे दो बलावे| aur is ghosna se Jaaton ka doosra bulaava to apne aap hi ban gaya....

First, This reservation is not as bad as some people are claiming.
Jats are 21-22% of the population in Haryana , not 27%. And Jats can also claim reservation within the EWS category. It is open to all castes, not just (General-Jats ).

Secondly, since No Act regarding this has been passed by the state govt unlike The ACT of Tamil Nadu. Due to poor legal foundation, this will be rejected by the Court.

i dont think that Jats and other OBC, Special OBC, SC/ST can claim in this category (assuming jats get reservation in special OBC category). Its only for general category who doesnt have any reservation.

Reservation according to caste has been done for long and those who could have reaped the benefit. We need to get away from. If at all we need reservation it has to be according to economic condition for the upliftmant of real poor.

OBC reservation already has provision for exclusion of creamy layer which in reality very similar to this one. So why so much excitment about this category?

Economic condition of a person can change overnight. Zameen biki aur economic condition change huyi - just a matter of few hours. How will this corrupt govt will keep track of such dynamic change and ensure that only right candidates will get the benefit. Dont look everything from congressman's eye. This 10% for economic backward class is just to increase corruption and adjust very own ppl. Common man who is poor will never ever get a certificate of being poor. baat karte ho!

जा कोए आपनी मेहनत तें रिच होग्या ,उहने आरक्षन कोणी मिले । उहने गेस भी महंगी लेनी पड़ेगी ,उह न टेक्स भी बाध देना पडेगा । आर कोए बन्दा दारु-पीपी के आर के कोए बन्दा कामचोर से आर गरीब-अ रहना चाहवे स ,उह ताहीं रिजर्वेशन दे के ने मुफ्त खोर बनाओ । यु जो सामाजिक असंतोष पैदा कार्या जाण लाग्र्या स ,इह की जिम्मेदारी कुण लेवेगा । पहलम तें -ए सरकारी नोकरियाँ में 80% लोग कामचोर भरे पड़े सें । आज के दिन जा कोए गरीब स ते आपनी कामचोरी के कारण स । काम की कोए कमी नहीं स कारन आला चाहिए । कई करोड़ बँगला देशी जब काम पा सके सें ते आड़े आले ने काम क्यूँ नहीं मिलदा , करण ने । मुफतखोर कभी विकास नहीं करता ,केवल याचना ,गुलामी और चमचागिरी ही कर सकता हे ।

retired commandent. Sh. Hawa Singh Sangwan ki Jats par koi bhi reports aap ootha ke padh sakte hain.....unhonen apni har report mein Hindu Jats in Haryana 27% of total population of Haryana find out kiya hai.......

so I have said it with proper reference but and eventhough considering your point that it is 21-22% then it would be your kindness to put your reference for same, which will further help me in analysing which reference is more reliable yours or Sangwan Ji's.

On one side we are crying about politicians taking money for jobs and saying that government jobs are only for those who are rich and on other side we are trying to push down a policy that is meant to help real poor.

The point behind economical-condition based reservation is support those are poor(and not everybody is poor because they are lazy or drink alcohol) but are deserving. Or who can not pay the likes of SSC or UPSC or HSC lakhs of Rs. for a government job.

No policy is 100% assured to give benefits to real right-holders. I am sure you have heard of several incidents where in even rich people get OBC/SC certificates by paying a huge amount of money for jobs.
