Right to Emergency Care:
Date Of Judgment: 23/02/2007.
Case No.: Appeal (civil) 919 of 2007.

The new rule implemented by Supreme Court....please read and be aware
Right to Emergency Care:
The Supreme Court has ruled that all injured persons especially in the case
of road traffic accidents, assaults, etc., when brought to a hospital /
medical centre, have to be offered first aid, stabilized and shifted to a
higher centre / government centre if required.
It is only after this that the hospital can demand payment or complete
police formalities.
In case you are a bystander and wish to help someone in an accident, please
go ahead and do so.
Your responsibility ends as soon as you leave the person at the hospital.
The hospital bears the responsibility of informing the police, first aid,
etc.
Please do inform your family and friends about these basic rights so that we
all know what to expect and what to do in the hour of need.

SO.....Here after please don't hesitate to help the victims of an accident
incase if u encounter...please raise Ur helping hands .....

Ek bar ek babaji samandar key kinarai baithaya tha. usnai dekhaya ek beechhu gotey khanta avai sai lahran mai. babaji nai sochi aak yo maraiga lahran key thapaerey kha kai . usnai hath dalya paani mai aar beechhu bahar fankna chahya.beechhu nai said dey see dank marya haath pai . dard hoya .kheench liya haath ekbai to . Pher haath gerya paani mai to beechhu nai to pher gaad diya dank. nayon paanch chhah baar huee. ek bai to babaji nai sochi aak marandey susrey nai . Pher khayal aaya aak yo to sanskaran ka raulla sai Jai beechhu aapna dank maaran ka sanskar nahi chhodta to ttoo jyan bachavan ka sanskar kayaon chhodey sai. babaji nai jor markai haath paani mai gerya aar beechhu bahar tha.

If they are adamant then why we should get defeated. One day we will one.

I have different views regarding my younger generation. They are very resposible if we rely them.I shall share some personal experience some time in this regard.

Thanks Dahiya ji for bringing up this information....
With this additional knowledge about the law one would now be in a better position to ensure that the hospital authority gives first preference to such patients instead of getting into unimportant query session.

Good to know what the law says. Definitely useful.

Though, I would assume a true Jat would smack any doctor
who refuses to treat an emergency case. I would and I know others
who have done so in the past.

However, note that the doctors often in such cases, as well as in
"gone cases/no chance cases" often use the "this is beyond my skills"
excuse to not get involved, rather than say "I won't do it". In such a case,
what does one do?

This is a good intentioned decision taken by the supreme court.......... quite a few ppl might even benefit from it....but the really poor ppl will not. I trust ppl to help transport such patients to the hospital.....but after that the nightmare will begin.

Here are a few reasons.......
If a seriously ill poor patient is brought in..........the doctors at the private hospital will let the patient die - they will not spend their time and money on that patient - but they still might get their payment from the govt by using their contacts in the health dept.

Secondly, is the government gonna pay the private hospitals for the care they provide? ....... if it is then it will be fraught with corruption.....private hospitals will make fake cases and the sarkari babus will split the loot like I said above.

If payment is a personal responsibility, who can guarantee payment to the private hospital??

Also, how many private hospitals in Delhi are equipped with ER facilities? What is meant by shifting the patient to government hosp after stabilization?? Will the government hospital send an ambulance in time to pick this patient up?.........I am sure you must have seen patients camp out sleeping on the filthy footpath outside safdarjung and AIIMS.

So this might benefit some non-critically injured patients who can pay the private hospital.............rest will die. Nobody gives a s**t what Supreme court says especially if illiterate , poor ppl are involved.

Problem yeh hai ki hamara culture mein beimaani aur besharmi koot koot ke bhari hai.......uska kya karega supreme court?

When the task of EXECUTIVE get performed by the judiciary, in no time judiciary will also loose its teeth and significance as has happened to the executive.........becoming ineffective and corrupt.

I m sorry to say Dahiya Sahab...I will be highly obliged...if you can provide us the Copy or some link...establishing the truthfullness of the above ruling by Hon'ble Supreme Court Of India (As I did not come across any such ruling by SC of INDIA in the case no 919 of 2007, disposed on Feb. 23rd, 2007)

May be the case number is mispelt or any other ambiguity...!

OK Sir,

U can take your time. Though I have all the details of the case mentioned by you, but I didnt find any such ruling by Hon'ble Supreme Court Of India.

A lot of people are getting this message in the inbox. But the authenticity of this message is still ambivalent.

Lets see what u have to see in this matter and Hope you could provide and guide us to the right ruling or right case no.
