शादी के बाद खरीदी गई पति की संपत्ति में महिला को हिस्सा सुनिश्चित करने वाले एक विधेयक को केन्द्रीय मंत्रिमंडल ने आज मंजूरी दे दी। प्रधानमंत्री मनमोहन सिंह की अध्यक्षता में हुई मंत्रिमंडल की बैठक में यह फैसला किया गया।
पति की संपत्ति में अधिकार देने के अलावा विवाह कानून (संशोधन) विधेयक 2010 का उद्देश्य गोद लिए हुए बच्चों को भी मां-बाप से जन्मे बच्चों के समान अधिकार दिलाना है। इससे पूर्व दो साल पहले राज्यसभा में यह विधेयक पेश किया गया था। फिर इसे कानून एवं कार्मिक संबंधी संसद की स्थायी समिति के पास भेजा गया। स्थायी समिति की सिफारिशों के आधार पर विधेयक का मसौदा फिर से तैयार किया गया और कैबिनेट द्वारा मंजूर यह विधेयक पति-पत्नी का तलाक होने की स्थिति में गोद लिए बच्चों को भी मां-बाप से जन्मे बच्चों के समान अधिकार का प्रावधान करता है।

सरकार ने संसदीय समिति की इस सिफारिश को भी हालांकि मान लिया है कि तलाक की स्थिति में पत्नी का पति की संपत्ति में अधिकार होगा लेकिन कितना हिस्सा मिलेगा, यह मामले दर मामले आधार पर अदालतें तय करेंगी।

Allowing courts to reduce or waive off the waiting period of six months for divorce by mutual consent: This is a good step in right direction.
Women get a share in property acquired during the marriage: This is also good, the quantum of share will be decided by courts on a case by case basis is not a good idea. Govt. should constitute a committee of intellectuals and provide clear guidelines on division of property.
Rights to adopted children at par with biological off-springs in case the parents go for a divorce: This is a good step in right direction.
While a wife can oppose a husband's plea for a divorce under the new "irretrievable breakdown of marriage" clause, the husband will have no such rights to oppose if the wife moves the court on the same grounds: As per my understanding, this is unconstitutional, rest it will be tested in courts in the time to come.: This is not a welcome step unless both spouses are allowed to use this plea.
