View Full Version : Require legal advice regarding conversion of tourist visa to student visa

Hi Everybody,

One of my friend's son come from India on tourist visa.Now he wants to join the school here .So he wants to convert tourist visa into student visa so that he can get admission here.

Is there any school in New Jersey or New York which will give him admission first and then help in converting tourist visa to student visa or vice-versa?

He was studing in 12th(PCM) in New Delhi.

Give me some advice or suggestions based on it.

It seems that your friend is on a B-2 visa, and he has not passed his high school.

So, in order to convert his B-2 to student visa, the following steps need to be taken.

1. First he must find a High School in US where he can seek admission.

2. He will have to furnish a proof of support for his education.

3. After admitting him in appropriate grade, the school will then issue papers (generally forms called I-20) to him.

4. He then will send those papers to the U.S. Citizenship and Immigration Service Center (or District Office) of the area where his school would be located.

5. These days it generally takes 4-6 months before he would have hear anything.

6. He must apply for a change of visa status before the expiry of current granted period of stay, otherwise big trouble would loom.

7. He can not attend school while the application is pending. Before 9/11/2001, the rules were not as strict.

8. Someone may suggest to go through some attorney. Neither is it necessary and nor is it recommended by USCIS. Once all papers are in order, USCIS gives no preference to cases submitted by attorneys.

Is there any school here who can give admission without student visa?
Do you have any idea of such type of school?

u will get admission w/o visa, bcos u need an admission to get the visa.
But u cannot start attending school before the visa is approved.
