    Relieving and experience letter

    Hi All,

    I have been working in IT firm for more than 2.5 yrs; now I have total experiences is 5 yrs.

    Due to some circumstance mine current organization has ceased mine Relieving and experience letters. Also, I had been asked to leave the organization without completing entire notice period.

    Can anyone advise me how I would be able to join my next company without Relieving and experience letters? As of now I have only salary slip, form 16, offer letter and revised salary letter.

    Your suggestions would be highly appreciated.

    1)Agar aap notice period complete ni kar sakte to aap company ko kuch amount pay kar sakte ho.
    Exampale agar 1 month notice period h lekin aap notice period complete ni kar sakte to aap company ko 1 month salay pay kar do. Yepolicy har company me hoti hai.

    2)Agar aapke pass starting se ab tak ki salary slips hain to next company me koi problem ni hogi. BTW next company last threee months ki salary slip leti hai.

    3)Aapke pass OFFER LETTER hai aur salary sleep b hai.....to koi problem ni honi chahiye kyuki offer letter me aapki joining date mentioned h aur last month ki aapki salary sleep hai.

    4)Next company me aap pehle he apni problem bata sakte ho ki main immediate join kar sakta hu lekin mere pass Relieving and experience letters ni honge kyuki merio company mujhe releave ni karna chahti but meri kuch family problems h isliye mujhe change karni h company. HR ko ye sab problems pata hoti hain yaar.

    5)Ek baat ka dhyan rakhna ki next company me ek form fill karate hain joining k time jisme aapko previous company k kuch bando ka reference dena hoat hai,so be carefull unki ka reference dena jo aapke jyda close hain.

    Not good yar-----it seems as clear ATL case

    in such cases company can hold ur reliving letter----n in case u want it desperately they would mention the same reason on the letter which is equally bad

    1st------if ATL hai toh make sure----poora notice period waive off hoga---u are not liable to pay a single penny

    Major problem-------BGV- REd ( back ground verification red report)

    bhai---koise bhi company join karega---agar aisee hi choti-moti hai toh pata nahi
    rest all organisation 3rd party back ground verification karwati hai----wahan fans jayega----4 future black list ho jayega

    salary slip just shows u worked there------but bgv ke liye hr ke pas proper email jati hai

    if u won't mind ----may i know on what grounds u were asked to leave???????????


    Boss-------agar retrenchment case hai toh----no issues---apha hr likh kar dega------u would get reliving n green bgv------plus notice period waive off

    ( par apki bat se yeh REtrenchment nahi aTL hi lag raha hai)


    advice--------mat dikha experience nayee jagah-----risk zyada------bgv fail hone ka

    Hi
    Try to get the relieving letter & your experience letter by doing some bargain or request.
    -All Major companies has background checking process, during background process your employer (who is not relieving you) will announce you Absconder which is not good at all.
    - While processing VISA they can ask you for both letters so this will reduce your chances for onsite visit etc.
    -You will not be able to proove your experience.. It may impact in future

    Thanks Rekha,

    May i know ATL fullform. I had raised few concerns against my senior manager to the management. On this basis I had been asked to leave organisation with immediate effect, but without relieving and experience letters. As requested with hr management they said they are trying to negotiate with Sr. Management about my relieving and experience letters.

    I am waiting for their response. I am worried about if sr. management deny to give my relieving and experience letters. I am hoping that sr.management wouldn't take such decision where someone career get spoiled.

    If the circumstances are as per your post above, then you can drag them to consumer court. Even if they are expelling you, they cannot deny the relieving letter because you have served them. Take opinion from some legal experts.

    Is it Consumer Court or labour court ???????

    Bhai, I am no legal expert. You may be correct in pointing out labour court, but does a company employee gets catogerized under "labour"?
    All I wanted to convey to him that he can take legal route to get his relieving letter. How exactly this needs to be done is to be guided by legal experts.

    The company will be made to issue experience certificate through legal recourse only as explained by you in the post under reference.
    But they cannot be forced to give good remarks about your work and conduct.

    let me explain the entire situation, here is the issue:

    n hr ne red report bhej di-

    no phir kabhi join nahi kar payega-----n at times-------there is common data base------where uska nam red mei highlight ho jayega

    he would be accused of " Concealing important professional information "


    n bad mei bhai----kitni safai de lo--------koi nahi sunta-----
    every bgv is a cost to company------ek bar red aa gayee------phir wapis karwane ke liye---bahut solid supporting evidence chahiye

    ek aur jugad hai---------for a while ek chutko company join kar------after that join koi achi wali--usmei chutko wala exprerience dikha-----

    usually company last job experience verify karwati hai ( bhai meri toh mei---hum bas last hi karwate hai)

    Logic----- a person may have worked with dozens of companies----for every company it is a cost to get bgv done---to cut on that cost----most companies prefer the last organisation

    ek sur jugad hai-------company ke HR ko pata le-----reliving chod-----bas green bgv bhej de-----kam khatam-


    every company as system---n it si maintained my humans-manually

    contact to HR dept in a proper way.... mere sath b last job esa hi hua tha regional HR manager ne RL dene mana kr diya tha... mera Boss ne bhi job change kr liya tha.... HR mumbai contact kiya aur EOD se phle RL ki scan copy 3 days baad hardcopy or mene regional manager ki phone e ese fagati ki ki usene mere baad 3 bhaiyo ka RL time se maga diya....,,,, raise u y issue to HO or corp office... try ATB......

    Hi Jitender,
    First of all, don't worry too much. you are having offer letter, revised compensation letter, Form-16 and all salary slips. Therefore, you are covered and have solid proof that you have worked for that company. If you are technically sound or do good in technical round, no one is going to give these letters a damn. You can tell the HR that you could not get the relieving letter from previous company. I know many people who were good technically and were able to justify their work and could get in top notch companies even their previous employer gave very negative feedback to the recruiter.

    yar yeh toh koi grounds nahi hai-----feedbacks n escalations are always entertained

    is it some big firm or koi choti moti

    bhai kabhi kuch jhol-jhal toh nahi kiya na -----kahin woh teri poori work history nikale -----n kuch complaince types mile

    kya bola tha-----mgmt ke against ---if i may ask?


    yar ATL---ke liye badi strong documentation chahiye---else employee can take employer to court---

    so plz recall kabhi bhi kuch jhol-jhal kiya hai------jiska unke pas evidence ho

    agar appointment letter hai toh reliving bhi dena hoga

    but boss---what is the use ---if us par ATL likha ho---some Integrity/Disciplianry concern par-

    aise reliving ka woh achal dalega

    not much use

    in aTL case ---every employer knows employee can drag to labor court

    so itni solid documentation hoti hai
    to add on experienced corporate lawyers------not much of use
