    देश के प्रधान मंत्री मोदी जी अपने मन की बात कार्यक्रम में किसानों को बता रहे हैं कि जमीन अधिग्रहण उनके लिए लाभदायक है। शायद किसान को अब तक पता नहीं था कि उनके लिए क्या लाभदायक है और क्या नुकसान दायक । यह तो मुर्गी मारकर अंडा निकालो और सोना बनाओ ऐसी बात हो गई। लगता है मोदी जी जमीन अधिग्रहण बिल पर ऐसे ही अड़े हुये हैं जैसे इन्दिरा जी एमर्जेंसी के लिए थी ।

    Government May Allow Land Ordinance to Lapse

    The government had brought in the ordinance on land acquisition on December 31 last year. It is to lapse on April 5 unless a law is passed in Parliament to ratify it government or reissues the ordinance.

    The good news for the agriculturists seems impossible in the present regime. The Land Acquisition Ordnance 2014 is going to be repromulgated before April 5.

    The absence of Rural Development Minister Virender Singh in this entire show is surprising?

    It is also surprising that Surface Transport Minister Nitin Gadkari is writing to other parties for support ? What is his role in the Land Matters ?

    Land acquisition ignites hundreds of mutinies

    About a quarter of India's districts are witnessing mass protests over land acquisition issues according to a study. It identified 252 land conflicts spread over 165 districts, spanning practically all states of the country, in 2013-14. This is an increase of over 40% over 2012 when an earlier study had recorded 177 disputes in 130 districts.

    This incendiary situation is the reason behind the bitter debate over the new land acquisition law both in the Parliament and outside. While many see takeover of land as essential for industrial development, the problems of compensating and rehabilitating those who get displaced by such projects remain unresolved. It is estimated that projects valued at Rs.6 lakh cr are stalled due to land acquisition issues.

    The data on conflicts was collated by the Society for Promotion of Wasteland Development (SPWD) and the Rights and Resources Initiative (RRI) from media reports and cases pending in High Courts and the Supreme Court.

    Land bill re-promulgated
    The Centre on Friday re-promulgated the land acquisition ordinance, barely a few hours after the BJP announced nationwide rallies from May 6 to drum up support for the contentious bill, stonewalled by the Congress-led opposition in Rajya Sabha.



    President Pranab Mukherjee signed the ordinance just a day before the earlier ordinance, promulgated in January, lapses on April 4.

    The government has pushed the land bill by saying reforms are needed to kickstart industries stalled due to want of land, but it has so far failed to convince an unrelenting opposition that the changes envisaged in the law are not anti-farmer.

    Nitin Gadkari is the Sibel of the BJP government.

    Lies of the Modi Government

    Thousands of hectares already acquired land, lie unused, yet Modi govt pushing for land bill


    • An investigation by HT reveals that thousands of hectares of land acquired by the government is lying unused in several states.
    • 15,000 hectares of 85,000 hectares of land acquired in the past 50 years by MIDC in Maharashtra has been awaiting allotment and lying idle for the past 15-20 years.
    • In Madhya Pradesh, 21,000 hacters of land, acquired of jetropha plantation project, remains unsed.
    • In Uttarpradesh 30% of land acquired by UPSIDC is yet to be developed.
    • According to UPSIDC managing director Manoj Singh, cancellation is a continuous process.
      • This is how this cancellation game is played to cheat the farmers. (This is not stated in the news item and is what I have came to know)
      • Government sends notices of forceful acquisition to farmers for a industrial or road project.
      • Land mafia than negotiates sale of land with farmers through their brokers.
      • The brokers informs to the farmers that the land is to be acquired by the government and that the buyers is an aware of this development.
      • So, the broker reasons with the farmer that since the buyer is paying higher rate than the government's rate, he should make the deal quickly without telling others.
      • The same game is played with some other farmers too.
      • The Government than cancels the land acquisitions of the area where the land mafia has purchased the land and develops the rest of the land.
      • When the land prices escalates, because of the development, the land mafia sells the land and moves on to other places leaving the original land owner high-and-dry.

    Hearing of objections under old land acquisition act of 1894

    The land acquisition act of 1894 passed by The British Govt used to give sufficient opportunity of hearing any person interested in any land being acquired. Looking to the attitude of the Present Govt of India to acquire land without consent of owner shows that Britishers were more justice lovers that present Indian Govt. I quote below Section -5A of land acquisition act of 1894


    Section -5A. Hearing of objections.


    (1) Any person interested in any land which has been notified under section 4, sub-section (1), as being needed or likely to be needed for a public purpose or for a Company may, [within thirty days from the date of the publication of the notification], object to the acquisition of the land or of any land in the locality, as the case may be.

    (2) Every objection under sub-section (1) shall be made to the Collector in writing, and the Collector shall give the objector an opportunity of being heard [in person or by any person authorized by him in this behalf] or by pleader and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, [either make a report in respect of the land which has been notified under section 4, sub-section (1), or make different reports in respect of different parcels of such land, to the appropriate Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government]. The decision of the [appropriate Government] on the objections shall be final.

    (3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land were acquired under this Act.

    The petitioners have contended that after issuance of notification under Sections 4 and 6 of the Land Acquisition Act by the state government, agents of builders started approaching them. The farmers sold their land to builders at a higher price than what was expected from the acquisition compensation from the state government. However, when the farmers sold off their land to the builders, the land notified under Section 6 was dropped from acquisition.
    It was argued that the very same land which was sold by farmers to builders at the price of R 25 lakh or so was further sold at the rate of R 5 crore per acre and on certain areas license for development was given to private builders.

    In my opinion we need to analyze the conditions of farmers of villages near to sectors in Haryana. Let see Gurgaon and Dharuhera area where Industrialization is more in Haryana. Try to compare the conditions of Villagers of these area before and after land acquired.

    Kindly enlighten us about the condition of the small and marginal farmers or to say common farmers as you are living nearby the region mentioned by you. Has their economic condition improved after their land acquisition or have they become landless labourers seeking work from others and that is not so easy to get these days of machine driven factories.

    विकास का पहिया तेज चलाने के नाम पर भूमि अधिग्रहण अधिनियम में केंद्र द्वारा प्रस्तावित संशोधन के पहले पिछले साल सरकार इस संबंध में अध्यादेश भी ला चुकी थी। इसमें किसानों की सिंचित जमीन भी ली जा सकेगी। साथ ही इसमें किसानों की अनुमति की जरूरत नहीं होगी। हालांकि 2013 के कानून में फसल देने वाली सिंचित जमीन का अधिग्रहण प्रतिबंधित था। भूमि अधिग्रहण का कानून देश में 1894 से है। जानते हैं, नए अधिनियम में क्या है-

    केंद्र सरकार द्वारा भूमि अधिग्रहण अधिनियम में प्रस्तावित संशोधन का देशभर में विरोध हो रहा है। इससे पहले लाए गए अध्यादेश के आते ही देशभर में किसान संगठनों द्वारा व्यापक विरोध जताया जाने लगा था। इस अध्यादेश को समझने से पूर्व पिछले कानूनों को जानना आवश्यक है।

    भूमि अधिग्रहण अधिनियम 1894

    औपनिवेशिक शासनकाल के दौरान बनाए गए इस कानून से मनमाने ढंग से किसानों की जमीन छीनी जाती थी, जबरन विस्थापन की स्थितियां पैदा की जाती थी। यह कानून विस्थापितों को बहुत कम अधिकार देता था। 1947 के बाद भी किसानों की जमीन इसी कानून के तहत ली जाती रही। विभिन्न सड़क परियोजनाओं, बांध परियोजनाओं के लिए विभिन्न राज्यों में हुए अधिग्रहणों में किसी में भी विस्थापित को स्थायी नौकरी नहीं दी गई। दोगुना या चौगुना मुआवजा कृषि भूमि दर पर दिया जाता है, जो व्यावसायिक दर से 20 से 30 गुना कम होता है।

    जबरन विस्थापन को झेल रहे गरीब किसानों, आदिवासियों ने वर्ष 2006 में कलिंग नगर आंदोलन के माध्यम से जबरन विस्थापन के विरुद्ध बिगुल बजा दिया। 2 जनवरी 2006 को ओडिशा के कलिंग नगर में जबरन भूमि अधिग्रहण का विरोध करने पर पुलिस द्वारा गोली चलाई गई, जिसमें कुल 14 आदिवासी मारे गए। नतीजतन सिंगूर, नियामगिरी, जगतसिंहपुर, भट्टा पारसौला, सरदना आदि जबरन विस्थापन विरोधी आंदोलन देश के विभिन्न भागों में फट पड़े। जबरन विस्थापन विरोधी संघर्षों से संप्रग सरकार ने एकमत से (पुनर्वास एवं पुनर्स्थापन तथा उचित मुआवजा का अधिकार- 2013) सितंबर 2013 में पारित किया।

    2013 के अधिनियम द्वारा अधिग्रहण के विरोध में किसानों को अपनी आपत्ति दर्ज करवाने का अधिकार दिया गया। मुआवजा बढ़ाने की राहत भी दी गई। पर्यावरण रक्षा व देश में खाद्य सुरक्षा के लिए भूमि अधिग्रहण पर कुछ रोक के प्रावधान भी किए गए।

    दिसंबर 2014 में शीतकालीन सत्र समाप्त होते ही भूमि अधिग्रहण अध्यादेश ले आया गया। यह नया अध्यादेश उन सभी परियोजनाओं पर लागू होता है, जो ग्रामीण व औद्योगिक अधिरचनाओं, ग्रामीण व शहरी गरीबों के आवास, विद्युतीकरण, औद्योगिक कॉरिडोर निर्माण से संबंधित है। यह अध्यादेश पब्लिक प्राइवेट पार्टनरशिप से चलने वाली योजनाओं पर लागू होगा। इन दोनों में इस अध्यादेश के परिणामस्वरूप 80 फीसदी प्रभावित किसानों से अनुमति लेने की आवश्यकता नहीं होगी तथा कई फसल देने वाली सिंचित जमीन को लेने की पूरी छूट होगी। सन 2013 के कानून की धारा 10 के तहत अनेक फसल वाली सिंचित जमीन के अधिग्रहण पर पूरी तरह प्रतिबंध था।

    इस अध्यादेश का एक मुख्य प्रावधान है कि सामाजिक प्रभाव आकलन करने की बाध्यता उपरोक्त में से किसी भी क्षेत्र में नहीं होगी। 2013 के कानून की धारा 4 अध्याय 2 में दिए गए सामाजिक प्रभाव आकलन के द्वारा निम्न अधिकारों की सुनिश्चतता की गई थी :-

    मूल्यांकन करने की प्रक्रिया में ग्राम सभाओं व पंचायत प्रतिनिधियों का पर्याप्त प्रतिनिधित्व प्राप्त था। यह सुनिश्चित किया जाएगा कि आम लोगों के उपयोग या सार्वजनिक उपयोग के लिए उक्त परियोजना को मूर्तरूप दिया जाए। परियोजना के लिए न्यूनतम भूमि ही अधिग्रहीत की जा रही है। अधिग्रहण से प्रभावित हो रहे परिवारों, कुल भूमि व संपत्तियों व उनकी कीमत, उनके निदान के लिए उठाए जाने वाले कदमों का मूल्यांकन पहले हो जाए। यह सुनिश्चित करना कि उक्त परियोजना के लिए खेती की जमीन की बजाय कोई और वैकल्पिक जमीन नहीं है।

    सामाजिक प्रभाव और उसकी कुल कीमत का आकलन तथा जीविका को होने वाले नुकसान। इस अध्यादेश में यह सारी सुनिश्चितताएं छीन ली गई हैं। पर्यावरण प्रभाव का मूल्यांकन भी सामाजिक प्रभाव के आकलन के साथ-साथ होना था। अब वह भी व्यर्थ हो जाएगा।

    यह अध्यादेश देश की जनता को अपनी प्राकृतिक संपदा से वंचित करता है। इससे किसानों की दशा और खराब हो जाएगी। समय-समय पर भूमि अधिग्रहण अधिनियम 1894 के तहत देश के अलग-अलग राज्यों में हुए भूमि अधिग्रहण को न्यायपालिका के समक्ष चुनौती दी गई। अक्सर अधिनियम में मौजूदा आपातकालीन धारा का उपयोग कर जमीन का अधिग्रहण किया जाता रहा है।

    जस्टिस जी.एस. सिंघवी व जस्टिस ए.के. गांगुली की दो सदस्यीय पीठ ने नवंबर 2011 में ग्रेटर नोएडा के शाबरी गांव के किसानों की जमीनों का अधिग्रहण रद्द कर दिया था। ग्रेटर नोएडा प्राधिकरण में किसानों से 156 हैक्टेयर जमीन औद्योगिक परियोजना के लिए अधिग्रहीत की थी। यह अधिग्रहण इस आधार पर रद्द किया गया, क्योंकि जमीन को अधिक मुनाफा कमाने के लिए व्यावसायिक डेवलपर्स को दे दिया गया था। शीर्ष अदालत के फैसले के बाद किसानों को उनकी जमीन वापस देने का फैसला ले लिया गया।

    अप्रैल 2013 में ओडिशा खनन निगम बनाम पर्यावरण व वन मंत्रालय व अन्य के मामले दायर याचिका में उच्चतम न्यायालय ने उड़ीसा के नियामगिरी पहाड़ियों में वेदांता को बॉक्साइट खनन की अनुमति दिए जाने के संदर्भ में माननीय उच्चतम न्यायालय ने ग्राम सभाओं को अधिकार दिया कि वे इस संदर्भ में निर्णय लें। उच्चतम न्यायालय की तीन जजों की पीठ ने ओडिशा के रायगड़ा और कालाहांडी की ग्राम परिषदों को तीन महीने में यह निर्णय करने का अधिकार दिया कि प्रोजेक्ट चल सकता है या नहीं। इस क्षेत्र के जंगलों में रहने वाले आदिवासियों के सांस्कृतिक, धार्मिक, सामूहिक एवं व्यक्तिगत आधारों पर प्रभाव की कसौटी पर प्रोजेक्ट चलने या ना चलने का निर्णय लिया जाएगा। उच्चतम न्यायालय के जस्टिस पी. सतशिवम और ए. के. पटनायक की पीठ ने टिप्पणी की कि राज्य सरकारों के अधिकारी कानून द्वारा प्रदत्त अधिकारों का दुरुपयोग कर रहे हैं। किसानों की उपजाऊ जमीन लेकर निजी क्षेत्रों को मुनाफा कमाने के लिए दी जा रही है

    ग्रेटर नोएडा व नोएडा प्राधिकरणों द्वारा दायर की गई लगभग 1000 से अधिक याचिकाओं को रद्द कर दो माह में मुआवजा देने को कहा है।

    फैक्ट- फरवरी 2015 में उच्चतम न्यायालय ने इलाहाबाद उच्च न्यायालय के उस निर्णय को कायम रखा, जिसमें नोएडा के किसानों को 64.7 फीसदी की दर से अतिरिक्त मुआवजा देने का निर्देश दिया गया है।

    As our experience of being in urbanized village in Delhi . With reference to my experience I see it in different way.
    Farmer should put condition before Govt instead of totally opposing it ...
    Condition to Acquire Land ...
    1. Village Lal Dora to be extended before Land Acquisition.
    2.No shoping mall or market within Acquired area.
    Market need to be permitted only in Village Lal Dora Area.
    This will give a lot of earning opportunity to villagers.
    3.No small scale industry in acquired area. Allow small scale industry only in Village Lal Dora area.
    4.Better Roads from City to Village and Village passage to be clear in Acquired area.
    5.Better skill development for village youths. Like - Electrical / Welding/ Sewing / Designing courses where higher education is not required.

    In our villages where there is enough Lal Dora most of the Jat family are earning more than Rs.50,000/- per month. When they were dependent on farming even family with 200 Bigha land were not well off. Exceptions are drug addicts and sharabi.

    Small farmers those who are not addicts to drugs and sharab are earning much better then before.
    They are now running shops/ Buiding Material / Welding / Electrical Shops. Small farmers are much better than big farmers now because they did not hasitate to learn other skill. Please visit some Gurgaon Urban Villages to know the situation.

    Sara rola paise ka hai. If the farmer gets adequate compensation at market rate, then he can buy land at other places, and pocket some money too. Alternatively, a farmer could be given a similar fartile land of the same size elsewhere plus some compensation for relocation.

    However, our rulers doesn't want this to happen. Industrialists and land mafia (a.k.a fraud politicians) wants the loot money by forcefully acquaring farmer's land.

    Could it be that this is your perspective and that they aren't happy with what they are doing? Could it be that they were forced to do these odd jobs?

    They were once master of their own and now they are forced to be labours or workers at the lowest level. Is this an upliftment or downgradation?

    Small farmers have become easy fodder to the neo-capitalist class as petty wage earners as landless labourers.

    You are talking of diversification of activities not economic changes brought about by land acquisition. In the category of big farmers some have bought land elsewhere whereas majority has used the easy come money in purchase of luxurious items and some have spent it solely to show off their neo-richness. If their lands were not acquired, they would have hesitated to sale it due to lok laaj, but now they and their succeeding generations are facing the big question mark, from where the bread would come.

    Acute problem of Unemployment and either indulgence in Anti-social activities or addiction are other offshoot evils being faced by majority of those families who have lost their chunk of lands inherited from their ancestors generation after generation as a security against hunger and deprivation in the NCR region too as is the case elsewhere.

    Condition to Acquire Land ...
    1. Village Lal Dora to be extended before Land Acquisition.
    2.No shoping mall or market within Acquired area.
    Market need to be permitted only in Village Lal Dora Area.
    This will give a lot of earning opportunity to villagers.
    3.No small scale industry in acquired area. Allow small scale industry only in Village Lal Dora area.
    4.Better Roads from City to Village and Village passage to be clear in Acquired area.
    5.Better skill development for village youths. Like - Electrical / Welding/ Sewing / Designing courses where higher education is not required.

    In our villages where there is enough Lal Dora most of the Jat family are earning more than Rs.50,000/- per month. When they were dependent on farming even family with 200 Bigha land were not well off. Exceptions are drug addicts and sharabi.
